3. Monitoring and Disclosure
We may monitor your communications and may disclose content and information about you, including contents of communications, if we deem it reasonably necessary to: (1) conform to legal requirements or respond to legal process; (2) ensure your compliance with this Service Agreement including maintaining this Service and the Code of Conduct; or (3) protect the rights, property, personal safety or interests of Tribe, its employees, its customers, or the public.

Were it not for that clause, Tribe.net would be violating the Stored Communications protection under federal law, which carries a $1,000 statutory civil damage per occurance and which is also a felony.
But since the Terms of Use say they can monitor your communications, it is no big deal. Or at least they think so. The clause gives them almost unlimited discretion.
Now here is the question I have, which they will only address by deleting this thread and unsubscribing me.
How often do they do this, and can any Tribe.net employee do it at any time, on a whim, or just to spy on people he doesn't like? Is there any internal guideline or constraint in place? What is stopping tribe.net employees from reading your emails? They have the power to do so, what makes you think they are not?

I dont think it's right myself but it has unfortunately become the way things are. I think as long as we are being honest and speaking from the heart most average people have nothing to worry about. Not that that makes it acceptable practice. But unless you are tallking about doing bad things or participating in illegal activities I don't think it should be a problem for most people. In todays society it has become a means of CYA = covering your ass to stay out of legal trouble. (Tribe and other companies that is) And if Homeland Security, the NSA, FBI, CIA, etc..... are already practicing such things as this, pretty much any and all communications can be and ARE monitored. The only plus to it is the FACT that this monitoring has actually helped in preventing several bad things from happening. The fact that there have been cases where peoples names have been put on lists they shouldnt be on for various reasons is unfortunate. The powers that be make mistakes unfortunately but I think is is looked at from the perspective that the many bad things that are prevented far outweigh the potential mistakes. I probably sound like a friggin PR lobbyist for Big Brother but this issue is a very real reality of the world we live in today. It will surely only increase in the future. The day has arrived already when the only true privacy we can have is if we are taking a dump in the can or way off in the wilderness somewhere. Even then, it may not be possible to escape the omnipotent electric eye!

Both Tribe and Myspace (among others) have been resources for law-enforcement for years. They went and asked permission from Tribe's owners a while back to install some sort of monitoring devices and were refused. The article that I reposted here back in '04 or so had them saying that they could monitor everything anyway and didn't really need anyone's permission. I guess it was just a courtesy on their part. So I assume it's being done remotely.
If you're a Fed, social networking forums would be a great place to obtain information. And as far as the emails sent over the Tribe server, well I wouldn't be surprised if they are read by law enforcent (BOMB!) that's a "Key Word" guaranteed to have an intelligence analyst reading it shortly.
"Sneak and Peek" warrants can be obtained on the slimest of evidence under the auspices of the "Patriot Act" and Feds can come into your home and basically look through your shit and copy your hard-drive if they feel like it.
I was personally targeted a few years back by an obvious underage sting. I had some 16 year old chick who I didn't know, never met, and never wrote write me and say she wanted to "run away and be with me." I just kept telling "her" to fuck-off until the cop left me alone. That was on Myspace.
